Durable power of attorney
Durable power of attorney is a authorized form, which could be used by any capable person to appoint another person to act as their representative to administer the financial affairs. The power of attorney is considered durable because it continues in full effect even if the person becomes disabled. Mostly in unfortunate times one needs the agent the most, this was the main reason for the creation of form. Not like the general power of attorney the Durable POA doesn’t becomes inoperative when the person who made the power of attorney becomes disabled. Though the person appointed has the power, he must operate under specified terms, conditions, guidelines and limitations drafted in the durable power of attorney. The other main advantage of Durable power of attorney is it can be used to protect the assets. Defining the authority of the agent is completely up to the principal. Under the Durable POA, the owner of the asset or the principal can make the power of the agent as limited or as broad according to the wish. A distinctive form is drawn up providing vast authorities to the agent or the supervisor so that he can manage any or all the financial affairs. Some owners or the principal may like that the agent handles certain assets or follows précised wish. For an example one may give the power to agent to handle the stocks, bonds, insurance, banking and matters relating to tax on your behalf.
On some occasions a Durable Power of attorney may have more than one agent. Therefore one will have to decide if they will work independently or resolve the issues together. Most of the people believe that it’s quite better to allow them to act independently to overcome the clash and court proceedings which could delay a decision. In most of the cases the principal name their second agent as their substitute in a situation when something bad or an avoidable circumstance occurs with the primary agent.
